1. Introduction

Bricks Pilot is a third-party WordPress plugin that provides AI-powered design automation and HTML/CSS conversion features for Bricks Builder users.

2. Definitions

• Service: The Bricks Pilot plugin, platform, website, and related services.
• User: Any individual who accesses or uses the Service.
• Content: AI-generated designs, converted code, and other materials created through the Service.
• Subscription Plan: The pricing tier selected by Users based on their usage needs (Pro, Business, BYOK, or Converter).
• BYOK: Bring Your Own Key - a subscription model where users provide their own AI API keys.

3. Account Registration and Authentication

3.1. Registration Method

The Service uses email-based registration for user accounts.

We collect only the following information during registration:

• Your name
• Email address
• Password (encrypted and securely stored)

We do NOT collect or store profile pictures.

3.2. Account Responsibilities

• You are responsible for maintaining the security of your account and password
• You agree that all activities under your account are your responsibility
• You must immediately notify us of any unauthorized use
• You must provide accurate account information
• You must be at least 16 years old to use the Service

4. Service Description

Bricks Pilot is a third-party WordPress plugin that extends Bricks Builder with:

• AI-powered design generation and automation
• HTML/CSS to Bricks Builder conversion
• Advanced element customization
• Integration with multiple AI providers (Anthropic Claude, Google Gemini, OpenAI, xAI, DeepSeek)

5. Subscription Plans and Pricing

5.1. Available Plans

• Pro: $25/month - 100 AI generations per month, unlimited conversions
• Business: $50/month - 300 AI generations per month, unlimited conversions
• BYOK (Bring Your Own Key): $8/month - Unlimited generations using your own API keys
• Converter: $5/month - Unlimited HTML/CSS conversions only (no AI features)

5.2. Pricing Terms

• All prices are in USD and exclude applicable VAT/taxes
• Final price may vary based on your country's tax regulations
• Subscriptions are billed monthly in advance
• Usage limits reset on the first day of each billing cycle
• Unused generations do not roll over to the next billing period

5.3. Payment Processing

All payments for subscription plans are processed through our third-party payment provider, Paddle.com. Paddle acts as our Merchant of Record and handles all payment processing securely.

By making a payment, you also agree to Paddle's terms and conditions. We do not store your full credit card information on our servers. Please review Paddle's privacy policy for information on how they handle your payment data.

6. Billing and Cancellation

• Subscriptions automatically renew each month unless cancelled
• You can cancel your subscription anytime from your dashboard
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial billing periods
• You retain access to paid features until the end of your paid period

7. BYOK (Bring Your Own Key) Plans

If using a BYOK subscription plan:

• You are responsible for obtaining and managing your own AI API keys
• You pay your AI provider directly for all API usage - This is a separate cost from your Bricks Pilot subscription
• API costs can vary significantly based on your usage and the AI model you choose
• We encrypt and store your API keys securely using AES-256-GCM encryption
• You must comply with your AI provider's terms of service
• We are not responsible for: API costs, rate limits, service availability, or billing issues from third-party AI providers
• You can change or update your API keys at any time through your dashboard
• You are responsible for monitoring your API usage and associated costs with your provider

8. Acceptable Use Policy

You agree NOT to:

• Resell, redistribute, or share access to the Service
• Use automated scripts or bots to abuse the Service
• Generate illegal, harmful, or offensive content
• Reverse engineer, decompile, or disassemble the plugin
• Attempt to bypass usage limits or restrictions
• Use the Service to create spam or malicious content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others

9. Intellectual Property

9.1. Your Content

You retain all rights to content you create using Bricks Pilot. Generated output, converted code, and designs created through the Service are yours to use as you see fit.

9.2. Our Intellectual Property

The Bricks Pilot plugin, including its code, design, documentation, and branding, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our software except as expressly permitted by your subscription.

9.3. AI-Generated Content

AI-generated content is provided "as-is" for your use. We make no claims to ownership of AI-generated content. You are responsible for reviewing and ensuring that generated content meets your needs and complies with applicable laws.

10. Service Quality and Technical Support

• We provide AI generation with Claude Opus 4.5 for Pro and Business plans
• HTML/CSS conversion supports all standard Bricks Builder elements
• Priority support is included with Pro and Business plans
• We strive to maintain 99.9% uptime but do not guarantee uninterrupted service

11. Refund Policy

We offer a 14-day money-back guarantee for first-time purchases. If you are not satisfied with the Service, contact [email protected] within 14 days of your initial purchase to request a full refund.

After the initial 14-day period, refunds are not provided for partial billing periods. See our Refund Policy for complete details.

12. Disclaimers and Limitation of Liability

Bricks Pilot integrates with third-party services including Bricks Builder, AI providers, and payment processors. We are not responsible for issues caused by:

• Bricks Builder updates or compatibility issues
• AI provider service disruptions or changes
• WordPress core or plugin conflicts
• Third-party hosting or server configurations

12.3. Limitation of Liability

The Company shall not be liable for any damages including:

• Lost business, profits, or revenue
• Direct, indirect, incidental, or consequential damages
• Compensatory, exemplary, special, or punitive damages
• Data loss or corruption
• Interruption or cessation of service
• Unauthorized access to your account or data

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Content you create or generate using the Service
• Infringement of any third-party rights

14. Account Termination

14.1. Termination by You

You may cancel your subscription and delete your account at any time from your dashboard. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will lose access to paid features after the billing period ends
• Your account data will be retained for 30 days, then permanently deleted

14.2. Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or abusive behavior
• Your payment fails or your account is delinquent
• We are required to do so by law

We will make reasonable efforts to notify you before termination, except in cases of severe violations or legal requirements.

15. Changes to Terms

• We reserve the right to modify these Terms at any time
• Material changes will be communicated via email or dashboard notification
• Continued use of the Service after changes constitutes acceptance of the modified Terms
• If you do not agree to the changes, you should cancel your subscription

16. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. We take data protection seriously and comply with applicable data protection regulations. Please review our Privacy Policy to understand how we collect, use, and protect your information.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Bosnia and Herzegovina, specifically the Republic of Srpska, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Srpska, Bosnia and Herzegovina.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

19. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings.
